N\u00e5r en kommune fastsetter en reguleringsplan, eller n\u00e5r et milj\u00f8direktoratet vurderer et inngrep i naturen, kan de beslutninger de tar for sitt saksomr\u00e5de, ogs\u00e5 f\u00e5 betydning for kulturminner.<\/p>\n\n\n\n

1.1 Kulturminneloven \u00a7 1 tredje ledd<\/h3>\n\n\n\n

Men etter kulturminneloven \u00a7\u00a01 tredje ledd skal det legges vekt p\u00e5 kulturminnelovens form\u00e5lsparagraf n\u00e5r det fattes vedtak etter andre lover. Dette kalles det sektorovergripende ansvar.<\/p>\n\n\n\n

1.2 Ansvar<\/h3>\n\n\n\n

Et sektorovergripende ansvar inneb\u00e6rer at det s\u00e6rlige ansvar som normalt p\u00e5hviler kulturminneforvaltningen, ogs\u00e5 skal gjelde for alle andre sektorer n\u00e5r de kommer i kontakt med kulturminner. Plikten omfatter alle type kulturminner og kulturmilj\u00f8er slik de er definert i kulturminneloven.<\/p>\n\n\n\n

1. 3 S\u00f8knad<\/h3>\n\n\n\n

Utover i den generelle oppfordringen i kulturminneloven \u00a7 1 tredje ledd finner en et mer praktisk og konkret uttrykk for det sektorovergripende ansvaret i kulturminneloven \u00a7\u00a025 annet ledd. For eksempel dersom kommunen mottar s\u00f8knad om \u00e5 rive eller i vesentlig grad endre et ikke-fredet byggverk fra tiden f\u00f8r 1850, plikter kommunen \u00e5 sende melding til fylkeskommunen senest fire uker f\u00f8r sp\u00f8rsm\u00e5let skal avgj\u00f8res.<\/p>\n\n\n\n

1.4 Bestemmelser<\/h3>\n\n\n\n

Hensikten med bestemmelsen om meldeplikt er \u00e5 hindre et ukontrollert tap av byggverk fra f\u00f8r 1850. \u00c5ret representerer et skille for byggevirksomhet i Norge. Industrialiseringens gjennombrudd rundt midten av 1800-tallet f\u00f8rte til store endringer i byggeskikken, med nye byggeteknikker og materialer. Bestemmelsen skal gi kulturminneforvaltningen en mulighet til \u00e5 vurdere verneverdien av byggverk og p\u00e5 den bakgrunn r\u00e5dgi kommunene slik at de selv f\u00f8rst kan ta stilling til behovet for vern.<\/p>\n","protected":false},"excerpt":{"rendered":"
